Daniel Whittemore

#2442, (-1683)
Pedigree Link

Parents

Children with Mary Mellins (b. estimated 1642, d. after 1693)

Biography

  • Daniel Whittemore was baptized on 31 July 1633 in Hitchin, Hertfordshire, England.
  • On 23 May 1661 "Danyell Whitemore" was summoned as a witness 23 May 1661 in a case about grazing cows.
  • He married Mary Mellins, daughter of Richard Mellins, on 7 March 1661/62 in Charlestown, Massachusetts.
  • In April 1662 Daniel and Mary lived in Malden, Massachusetts.
  • On 15 June 1669 15 Jun 1669 a petition to the court is filed for Daniel as follows "Daniel Whittamore, being one of ye listed souldiers in ye foot company, hath by sufficient testimony declared his inability to attend the Company any longer, by reason of a continued distemper in his head. Which I leave to ye Consideration of ye Honoured County Court now sitting at Charlestowne". Signed Laurance Hammond (middlesex County Court Papers Folder 53 Group 6).
  • In 1670 During the October court held in Charlestown in 1670 the jury brought in a verdict for the plaintiff in the case of Daniel Whitamore vs. Samuel Whitamore. In this case Daniel won the sum of £3.5 plus costs of court. It seems that his younger brother Samuel had spent the winter at Daniel's house and Samuel had also wintered his horse in Daniel's barn. Apparently Daniel thought that Samuel's cutting wood and hauling it for him was not enough recompense for a winter's lodging and feeding, so he sued for more and won it. This case in interesting also, for there are depositions by two other brothers, Nathaniel and Abraham (Middlesex County Court Papers Folder 53, Group 2).
  • On 9 April 1678 On 9 Apr 1678 a list naming the heads of families dwelling at Mystic Side (eighteen in all) includes "Dan'l Whittamoar" (History of malden p489; History of Charlestown p184).
  • On 21 December 1680 On 21 Dec 1680 the jury brought in a verdict for the defendant in a lawsuit between Daniel Whitamore and John Marable, defendants, and Benjamin Whittemore, attorney for Benjamin Butterfield, plaintiff. The suit was over the final distribution of the widow's third of the estate of Daniel's and Benjamin's deceased father, Thomas. Hannah, his widow, having married Benjamin Butterfield after Thomas' death, and she having died in 1677 (middlesex Court Records Vol 3 p329).
  • He died on 11 May 1683 in Malden, Massachusetts.
  • Inventory of his estate was taken on 18 December 1683 Inventory £234 5s. Administration given to Mary 18 Dec 1683.
  • Daniel Whittemore, late of Charlestown, deceased, "did in his lifetime sell a certaine lott of land & wood growing thereon containing 24 acres...in Charlestowne near Spot Pond brook which was granted by Charlestowne in right of Thomas, father of said Daniel...to Joseph Waite of Malden for ten pounds in money, but died before he had made a legall conveyance of ye land to said Joseph Waite". So, for 16 pounds more money paid by Waite, "Mary ye relict widow & administratrix, & Daniel eldest son & administrator of ye said Daniel deceased, & in consideration of ye forementioned honest bargain", sell above land to Waite. Witnesses: John and Benjamin Whittemore. Dated 15 Dec 1691. Acknowledged by Mary and Daniel 6 Nov 1693 Recorded 21 Nov 1693 (Moddlesex Deeds, vol 19 p229) This is the land, mentioned earlier, granted in the right of Thomas in 1664 after his decease.

Will

Daniel Whittemore left a will Daniel died suddenly, as his will was not made until the date of his death. He left a third of estate to wife during her lifetime, his eldest son Daniel the dwelling house and adjoining land, to John the rest of the land; Daniel to have 3 parts meadow, John 2 parts meadow. His 7 younger children to have only £8 apiece except for his eldest daughter Mary, and she shall have £10..1
